  • the source of generation;
  • whether it's listed as a acutely toxic or blah blah substance (P list), or 
  • conduct testing to identify hazardous characteristics.

In most cases, your company is responsible for the waste long after you have "disposed" of it. This "cradle to grave" approach to waste management is the driving force behind the state and federal hazardous waste management programs, as mandated by the Resource Conservation and Recovery Act (RCRA) and its amendments.

Your potential long-term financial liability for these wastes is established under provisions in the Comprehensive Environmental Response and Compensation Liability Act (CERCLA) also known as Superfund. Businesses have and can be held responsible for clean-up costs at landfills and other disposal sites years after the waste actually left their facility.
